Our recommendations focus on the need to adopt mandatory data processing principles and rules governing the use of consumer consent.

Today, the Minderoo Centre for Technology and Democracy has submitted evidence to the US Federal Trade Commission Trade Regulation Rule on Commercial Surveillance and Data Security.

Our recommendations draw on a comparative analysis of the European data protection regime. We are mindful that while lessons can be learned from the European Union, any rules imported must be adapted to the specific American context.

 This submission has three parts:

(i)                  the report contextualizing our advice,

(ii)                specific answers to selected questions of the FTC’s ANPR submission request, and

(iii)               a comparative overview of data processing principles.
